KENYAN JOURNALIST TONY GACHOKA WANT CHARITY NGILU TO NOMINATE HIM AS A LAW MAKER

Journalist Tony Gachoka has sued the Charity Ngilu-led-National Rainbow Coalition (NARC) for allegedly failing to list him as its nominee to the National Assembly

to represent persons living with disability. In the suit filed through the law firm of Miller and Company Advocates, Gachoka claims that he was to be nominated by the

National Rainbow Coalition under the Azimio Coalition as a person living with disability but realised that his name was not in the list published by IEBC.

He wants court to direct NARC party to forward an amended list to the IEBC with an inclusion of him as the first nominee to represent persons living with disabilities.

“I have justified reasons to believe that there was a malicious intent to shut me out of the party list which was a violation of my constitutional right. As a person living

with disability, I had a legitimate expectation to be number one on the nomination list,” said Gachoka. He says the NARC under the Azimio La Umoja Coalition had

undertaken to have him first in the list on its nomination list being a person living with disability. But in the list submitted to the Independent Electoral and Boundaries

Commission (IEBC) his name did not appear.

 

The former KTN host said he was surprised when he discovered that his name was not on the list despite having qualified for first priority due to his condition.

“None of the Azimio affiliate parties has nominated to the National Assembly a person living with disability which is in contravention of the Constitution. All the

nominees are therefore null and void,” he said. According to former KTN news presenter, both the coalition and Charity Ngilu failed to object to his nomination

and that he does not understand why IEBC failed to gazette his name as a Nominated Legislator. High Court Judge Ogolla will deliver the judgement on 9th of

February year 2023.
